Well, its only getting worse for Auburn fans. Now, they can’t even try to raise money to buy beer by selling clever novelty items like a six finger foam hands with the words “Auburn” or “War Eagle” on them. What has this world come to? Anyway, while everyone was talking about that Obama fellow yesterday, Magistrate Judge Charles Coody issued an opinion stopping Mike Moody and sixfingeryear.com from marketing, distributing, or selling six finger foam hands with the terms “Auburn,” “Auburn University,” ”Auburn Tigers” or ”War Eagle.” And who would want to stop such a thing? Bammers. Nope, Auburn University:

Feeling perhaps like a quarterback sacked by his own team, Moody and sixfingeryear.com are now being sued by his alma mater [Auburn University]….

What’s worse, Judge Coody, showing his apparent bammeristic qualities, decided it would be alright to throw in a few snide remarks: 

However, at least until the end of November 2008, Auburn has a six-game winning streak against the now surging Crimson Tide of Alabama.

And then even going so far as to cite Wikipedia (it’s always a credible source for legal opinions) for the proposition that Auburn’s “War Eagle” story is a myth (probably is, but who knows). Though, we’ll give him credit. Several football references and even going so far as to take judicial notice of “football in the State of Alabama”. Also, he’s probably the first judge to cite a Rivals.com site in a legal opinion (again, another credible source). Though, with all due respect to Judge Coody, we’d like to note that Tubs actually threw up 7 fingers in his Middle East tour in May 2008, not six. Guess he should have cited the FOTP blog for that point in the opinion. We wonder why he didn’t? Credibility issues probably.

And all of this because a guy who sold 14 foam fingers to his friends for make some beer money. Wow. But, as Judge Coody inferred, all of this won’t matter after the end of this month anyway. Plus, a seven finger hand would look ridiculous.
